Terms of service.

These terms cover how you can use the Trailmark Studios website as it is today: an informational site for a pre-launch studio. Individual apps and games will add their own terms as they launch.

Using this site

The basics.

By using this website, you agree to these terms. The site is provided for general information about Trailmark Studios and its products. It does not currently offer accounts, payments, downloads, or playable releases.

Who these terms are with

Trailmark Studios is an independent studio based in Alberta, Canada. In these terms, "Trailmark Studios," "we," "us," and "our" mean the studio, and "you" means anyone who uses this website. You can reach us any time at hello@trailmarkstudios.com.

Who can use the site

This site is intended for a general audience. To join our waitlist or otherwise share your email with us, you should be old enough to agree to these terms where you live — generally the age of majority — or have a parent or guardian's permission. The site is not directed to children, and we do not knowingly collect their information.

Intellectual property

The website's content, design, branding, logos, product names, and product concepts belong to Trailmark Studios unless otherwise noted. Please do not copy, redistribute, or reuse them without our permission. You are welcome to link to the site and to share our public posts.

Information shared in good faith

Product descriptions, status labels, screenshots, concept art, and timelines describe work in progress and are shared in good faith. They may change, be delayed, or be discontinued at any time, and nothing here is a promise that a particular product or feature will ship.

The waitlist

If you join our waitlist, you are asking us to email you occasional studio updates, and you can unsubscribe at any time using the link in any message. How we handle your email address is described in our Privacy Policy.

Acceptable use

Please use the site as it is meant to be used: to learn about the studio and its products. Do not try to disrupt, damage, or overload it, access it in unauthorized ways, scrape or harvest it at scale, or use it to break the law or infringe anyone's rights. We may limit or block access to protect the site and the people who use it.

Third-party services and links

This site relies on and links to third-party services — for example, Vercel (hosting and analytics), Buttondown (waitlist emails), and embedded Spotify players. We do not control those services and are not responsible for their content, availability, or practices; their own terms and policies apply when you use them.

Provided “as is”

The website is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not guarantee that the site will be accurate, complete, uninterrupted, error-free, or secure, and we may change, suspend, or discontinue any part of it at any time without notice.

Limitation of liability

To the fullest extent permitted by law, Trailmark Studios will not be liable for any indirect, incidental, or consequential damages arising out of your use of, or inability to use, this website. Some places do not allow certain warranty disclaimers or liability limits, so parts of this and the section above may not apply to you; where that is the case, they apply only to the extent the law allows.

Product terms

Accounts, purchases, subscriptions, downloads, and playable releases will each be governed by their own terms and policies, presented at sign-up or purchase, which will apply in addition to — or instead of — these terms for those products.

Governing law

These terms — and any dispute arising out of them or your use of this website — are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, where Trailmark Studios is based, without regard to conflict-of-laws rules. You agree that the courts located in Alberta are the appropriate place to resolve any such dispute.

Nothing in these terms removes or limits rights you have under the mandatory consumer-protection laws of the place where you live that cannot be waived by agreement. Where those laws give you stronger protections, those protections apply.

General

If any part of these terms is found to be unenforceable, the rest stays in effect. If we do not enforce a term right away, that is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and Trailmark Studios about your use of this website.

Changes and contact
